Short answer: almost certainly yes. In Virginia, most dock construction and significant repairs require permits from state and federal agencies. Here's what you need to know.

Who Permits Docks in Virginia?

Virginia Marine Resources Commission (VMRC) VMRC regulates anything built waterward of mean low water (MLW) — which includes most docks. They issue permits for structures on state-owned bottomland.

U.S. Army Corps of Engineers The Corps reviews the federal impact of construction in navigable waters. Most residential docks qualify for a Nationwide Permit 18, which streamlines the federal review.

Both applications are submitted together through Virginia's Joint Permit Application (JPA) process.

What Requires a Permit?

  • New dock construction (virtually all cases)
  • Pier extensions over 50 feet into tidal water
  • Significant structural repairs or replacements
  • Boat lifts permanently attached to the structure
  • Bulkheads and seawalls

What typically doesn't require a full permit:

  • Minor repairs using the same footprint and materials
  • Seasonal equipment (floating dock sections, ramps)

How Long Does It Take?

Typical residential dock permits in the Northern Neck take 60-90 days from submission to approval. Projects in sensitive habitat areas (seagrass beds) or involving larger commercial structures expect longer review times.
